BeeSpoke Terms of Service

Welcome to BeeSpoke (the "App"). These Terms of Service ("Terms") govern your access to and use of the App, which is currently in a prototype or early development phase. By using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Use of the App
You may use the App for personal, non-commercial testing and feedback purposes. As this is a prototype, features may change or be removed at any time without notice. We do not guarantee the functionality, performance, or availability of the App.
You agree not to:
Use the App for any unlawful or unauthorized purpose
Attempt to reverse-engineer, scrape, or extract data from the App
Circumvent or interfere with any security features of the App
Submit false, misleading, or harmful content through any App feature
Use the App in a way that could harm other users or third parties
2. Eligibility
You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use the App.
3. User Accounts
You may be required to create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately if you suspect unauthorized use of your account.
4. Data and Privacy
We may collect data to support functionality, improve the App, and provide language learning services. This includes text you type, audio you record, and usage data. By using the App, you consent to this data collection. All data is handled in accordance with our Privacy Policy, available at beespokeapp.com/privacy.
Note: As this is a prototype, data storage and security practices are still being hardened. Please do not enter sensitive personal information into the App.
5. Intellectual Property
All content, designs, and code within the App are the intellectual property of BeeSpoke, Inc. You may not copy, distribute, or reverse-engineer any part of the App without our express written permission. Nothing in these Terms grants you any ownership rights in the App or its content.
6. Feedback
We welcome your feedback and suggestions. By submitting feedback, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use and incorporate it into the App or other products, without any obligation to compensate you.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantees about the reliability, accuracy, or availability of the App.
8. Limitation of Liability
To the fullest extent permitted by applicable law, BeeSpoke, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of revenue, or loss of goodwill — arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of these Terms or your use of the App shall not exceed the greater of (a) the amount you paid us in the three months preceding the claim, or (b) $50 USD.
9. Changes to Terms
We may update these Terms at any time. When we make material changes, we will provide notice via in-app notification or email at least 7 days before the changes take effect. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
10. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if you violate these Terms. Upon termination, your right to use the App ceases immediately. Sections 5, 7, 8, 11, and 12 survive termination.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.
For any dispute with a value under $10,000, you agree to first attempt resolution by contacting us at info@beespokeapp.com. If unresolved within 30 days, either party may pursue formal legal action.
12. General
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and BeeSpoke, Inc. regarding your use of the App and supersede any prior agreements.
